1.A. We also may collect personally identifiable information that you provide to us, such as your name, address, phone number or email address. If authorized by you, we may also access profile and other information from services like Facebook.

Many devices will indicate through an icon when location services are operating. We only share this location information with others as approved by you.

6. We remove personally identifiable information (such as your name, address, email or phone number) and other preferences associated with your account promptly after you delete your account. We may retain other data indefinitely.

7. We generally do not share personally identifiable information (such as name, address, email or phone) with other companies for marketing purposes.

9. In order to serve you, we may share your personal and anonymous information with other companies, including vendors and contractors. 10. Analytics companies may access anonymous data (such as your IP address or device ID) to help us understand how our services are used. They use this data solely on our behalf. 11. We take reasonable steps to secure your personally identifiable information against unauthorized access or disclosure. We encrypt transmission of data on pages where you provide payment information. However, no security or encryption method can be guaranteed to protect information from hackers or human error.

13. We engage certain trusted third parties to perform functions and provide services to us. We may share your Registration Information with these third parties, but only for the purposes of performing these functions and providing such services.

14. In the event that we or any of our affiliates are involved in a bankruptcy, merger, acquisition, reorganization or sale of assets, your information may be sold or transferred as part of that transaction.

Terms of Use

By accessing or using the Cheers website (getcheers.co), the Cheers service, or any applications (including mobile applications) made available by Cheers (together, the "Service"), however accessed, you agree to be bound by these terms of use ("Terms of Use"). The Service is owned or controlled by Who's That, Inc. ("Cheers"). These Terms of Use affect your legal rights and obligations. If you do not agree to be bound by all of these Terms of Use, do not access or use the Service.

There may be times when we offer a special feature that has its own terms and conditions that apply in addition to these Terms of Use. In those cases, the terms specific to the special feature control to the extent there is a conflict with these Terms of Use.


General Apple Application Terms

1. This EULA is concluded between the Cheers application and you, the user, only, and not with Apple. Cheers, not Apple, are solely responsible for the this application, Cheers, and the content thereof.

2. The license to use this application is non-transferable, and must abide by the Usage Rules set forth in the App Store Terms of Service.

3. We, Cheers, are solely responsible for providing any maintenance and support services with respect to the Licensed Application, as specified in the EULA, or as required under applicable law. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Licensed Application.

4. In the event of any failure of the Cheers Application to conform to any applicable warranty, the end-user may notify Apple, and Apple will refund the purchase price for the Licensed Application to that end-user; and that, to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Cheers application, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be Your sole responsibility.

5. Cheers, not Apple, is responsible for addressing any claims relating to the Cheers application or the end-user’s possession and/or use of that, including, but not limited to: (i) product liability claims; (ii) any claim that the Cheers application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection or similar legislation.

6. In the event of any third party claim that the Cheers application or your possession and use of the Cheers application infringes that third party’s intellectual property rights, Cheers, not Apple, will be solely responsible for the investigation, defense, settlement and discharge of any such intellectual property infringement claim.

7. By downloading this application and signing up you are warranting that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted.

8. The Cheers application and you, the end user, agree that Apple, and Apple’s subsidiaries, are third party beneficiaries of the EULA, and that, upon your acceptance of the terms and conditions of the EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce the EULA against the end-user as a third party beneficiary thereof.


Basic Terms

1. You must be at least 17 years old to use the Service.

2.You may not post violent, nude, partially nude, discriminatory, unlawful, infringing, hateful, pornographic or sexually suggestive photos or other content via the Service.

3. You are responsible for any activity that occurs through your account and you agree you will not sell, transfer, license or assign your account or any account rights. You agree that you will not create an account for anyone other than yourself. You also represent that all information you provide or provided to Cheers upon registration and at all other times will be true, accurate, current and complete and you agree to update your information as necessary to maintain its truth and accuracy.

4. You agree that you will not solicit, collect or use the login credentials of other Cheers users.

5. You are responsible for keeping your password secret and secure.

6. You must not defame, stalk, bully, abuse, harass, threaten, impersonate or intimidate people or entities and you must not post private or confidential information via the Service, including, without limitation, your or any other person's credit card information, social security or alternate national identity numbers, non-public phone numbers or non-public email addresses.

7. You may not use the Service for any illegal or unauthorized purpose. You agree to comply with all laws, rules and regulations (for example, federal, state, local and provincial) applicable to your use of the Service and your Content (defined below), including but not limited to, copyright laws.

8. You are solely responsible for your conduct and any data, text, files, information, images, graphics, photos, profiles, links and other content or materials (collectively, "Content") that you submit, post or display on or via the Service.

9. You must not change, modify, adapt or alter the Service or change, modify or alter another website so as to falsely imply that it is associated with the Service or Cheers.

10. You must not create or submit unwanted email, comments, likes or other forms of commercial or harassing communications (also known as "spam") to any Cheers users.

11. You must not interfere or disrupt the Service or servers or networks connected to the Service, including by transmitting any worms, viruses, spyware, malware or any other code of a destructive or disruptive nature. You may not inject content or code or otherwise alter or interfere with the way any Cheers page is rendered or displayed in a user's browser or device.

12. You must not create accounts with the Service through unauthorized means, including but not limited to, by using an automated device, script, bot, spider, crawler or scraper.

13. You must not attempt to restrict another user from using or enjoying the Service and you must not encourage or facilitate violations of these Terms of Use or any other Cheers terms.

14. Violation of these Terms of Use may, in Cheers's sole discretion, result in termination of your Cheers account. You understand and agree that Cheers cannot and will not be responsible for the Content posted on the Service and you use the Service at your own risk. If you violate the letter or spirit of these Terms of Use, or otherwise create risk or possible legal exposure for Cheers, we can stop providing all or part of the Service to you.


General Conditions

1. We reserve the right to modify or terminate the Service or your access to the Service for any reason, without notice, at any time, and without liability to you. You can deactivate your Cheers account by emailing info@getcheers.co and giving your email.

2. Upon termination, all licenses and other rights granted to you in these Terms of Use will immediately cease.

3. We reserve the right, in our sole discretion, to change these Terms of Use ("Updated Terms") from time to time. Unless we make a change for legal or administrative reasons, we will provide reasonable advance notice before the Updated Terms become effective. You agree that we may notify you of the Updated Terms by posting them on the Service, and that your use of the Service after the effective date of the Updated Terms (or engaging in such other conduct as we may reasonably specify) constitutes your agreement to the Updated Terms. Therefore, you should review these Terms of Use and any Updated Terms before using the Service. The Updated Terms will be effective as of the time of posting, or such later date as may be specified in the Updated Terms, and will apply to your use of the Service from that point forward. These Terms of Use will govern any disputes arising before the effective date of the Updated Terms.

4. We reserve the right to refuse access to the Service to anyone for any reason at any time.

5. We reserve the right to force forfeiture of any username for any reason.

6. We may, but have no obligation to, remove, edit, block, and/or monitor Content or accounts containing Content that we determine in our sole discretion violates these Terms of Use.

7. You are solely responsible for your interaction with other users of the Service, whether online or offline. You agree that Cheers is not responsible or liable for the conduct of any user. Cheers reserves the right, but has no obligation, to monitor or become involved in disputes between you and other users. Exercise common sense and your best judgment when interacting with others, including when you submit or post Content or any personal or other information.

Pricing and Refund Policy

1. Items are sold for the price listed in the application and are provided by our third-party partners.

2.Purchases made in the app cannot be exchanged. Purchases made in the app cannot be refunded, plans cannot be cancelled, and refunds will not be issued except in the following circumstances:

  • If you attend the restaurant or bar on the date you agreed to attend at the specified time you agreed to meet, but do not receive one complimentary drink or one complimentary appetizer of your choosing from the restaurant or bar where you agreed to go, on the date you agreed to go out.

3. It should also be noted that:

  • You may reject a refund within 45 days of receiving the refund, but if you do not reject the refund by notifying us within 45 days you will be deemed to have accepted the refund in full and final settlement of any and all claims, actions, demands and proceedings you may have against Cheers arising out of the purchase for which you received the refund.
  • Except as expressly stated otherwise, purchases made via the App are non-cancellable and non-refundable.
